29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact: (a) At the project on or about February 1, 2013, where hand protection was not used when mixing and/or applying Hansen Portland cement.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) At the front retaining wall structure on or about February 1, 2013; where at least one employee applying plaster to the top portion of the retaining wall was exposed to falling approximately 8 feet to the lower level.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support, and a grasping device, such as a grab rail, was not provided to assist the employees in mounting and dismounting the ladder: (a) At the front retaining wall structure on or about February 1, 2013; where employees used a wooden job made ladder to access the top of the retaining wall that did extend at least 3 feet (.9 m) above the upper landing surface.
