29 CFR 1926.20(b)(2):       The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):      Employees were operating a Bay Shore Systems Drill Model number LLM-30 connected to the boom end of a Caterpilliar Excavator and were working approximately 4 feet from a 7.2kV power line which was not protected against contact.  The employer did not maintain programs which provided for frequent and regular inspection of the jobsite by a competent person to prevent such contact from happening.

29 CFR 1926.600(a)(6)(i): For lines rated 50kV or below, a minimum of 10 feet was not maintained between the energized line and the equipment.      On or about 3/1/13, employees were operating a Bay Shore Systems Drill Model number LLM-30 connected to the boom end of a Caterpillar Excavator and were working approximately 4 feet from a 7.2kV power line which was not protected against contact.
