29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: On or about 3/28/2013, at the above addressed job site, employees were installing a new roof on a two-story residential home and were not protected from falls through skylights.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about 3/28/2013, at the above addressed job site, employees were installing a new roof on a two-story residential home and were not protected from falls, whereas the employees were not wearing fall protection equipment. Instance a: Employees were working on the sloped section of the roof. Instance b: An employee was working on the flat section of the roof.
