29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) West Side of the House - On or about December 28, 2012, a work leader and a laborer were observed in an unprotected class C soil excavation measuring 7 feet deep 30 inches wide and 13 feet long without having a ladder for egress exposing them to a cave-in hazard.  No abatement certification or documentation required.

29 CFR 1926.651(l): Guardrails complying with 1926.502(b) were not provided where walkways were 6 feet (1.8m) or more above lower levels  a) West Side of the House - On or about December 28, 2012, workers were observed crossing an unguarded class C soil excavation by walking across a cut piece of 5/8 inch plywood measuring 2 feet wide by 4 feet long exposing them to a 6 1/2  foot fall hazard.  No abatement certification or documentation required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):  a) West Side of the House - On or about December 28, 2012, a work leader and a laborer were observed in an unprotected Type B soil excavation measuring 7 feet deep 30 inches wide and 13 feet long without having an installed shoring system exposing them to a cave-in hazard.
