OSHA ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to glutaraldehyde vapors, which may cause nose, throat, eye and skin irritation, skin sensitization, contact dermatitis or skin burns, and central nervous system impairment: a. On or about April 26, 2013, at the sterilization room, employees manually exchanging disinfectant were exposed to glutaraldehyde vapors at concentrations capable of endangering the employee's health.

On or about April 26, 2013, at the sterilization room, employees manually pouring disinfectant into the basin of an endoscope re-processor were expose to glutaraldehyde vapors at concentrations capable of endangering the health of the employees and the employer did not provide a respirator when necessary to protect the health of the employees.

On or about April 10, 2013, Registered Nurses, Circulators, and Scope Technicians were exposed to bloodborne pathogen hazards while working in the pre-op, procedure rooms, recovery, and sterilization areas and the employer did not make available the Hepatitis B vaccine to employees after training had been provided nor within 10 days of initial assignment.
