29 CFR 1926.501(b)(1):  Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.       (a)  American Civil Constructors, Inc. @ Rocky Mountain National Park/Bear Lake Road, Estes Park, CO 80511:  On and before April 5th, 2013, the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system, in that, an employee engaged in tree removal operations was working in close proximity to a fall hazard of approximately 13 feet while sitting on and straddling the existing guardrail system. This condition exposed the equipment operator to a fall hazard of approximately 13 feet.
