29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    On or about April 19, and at times prior thereto,  the employer did not provide adequate safety training to his employees, particularly in the area of working around large moving equipment.  Employees were exposed to being struck by large equipment and material.

29 CFR 1926.1412(f)(7): The employer did not document, maintain, or retain for a minimum of 12 months the items checked, the results of the inspection, the name and signature of the person conducting the inspection, and the date of the inspection.        On or about April 19, 2013, and at times prior thereto, the employer was using a used sideboom they had recently purchased and had not documented the annual/comprehensive inspection of the mechanical moving parts on the sideboom, exposing employees to serious injury from crushing and struck by hazards.

29 CFR 1926.1419(a)(2): A signal person was not provided when the equipment was traveling and the view in the direction of travel was obstructed.    On or about April 19, 2013, and at times prior thereto, the employer did not designate a dedicated ground person to act as a signal person or spotter who had a clear and unobstructed view in the direction of travel for the sideboom crane, exposing  employees to serious injury or death from crushing and struck by hazards.
