29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  1. At the time of the inspection, employees including the owner of the company had been operating a fork truck without training and/or certification to drive a fork truck.

29 CFR 1910.212(b): Anchoring fixed machinery. Machines designed for a fixed location shall be securely anchored to prevent walking or moving.  1. In the fabrication area, employees were operating a Ryobi ten (10) inch drill press that was not anchored to the work bench to prevent movement.  2. Inside of the wood shop, employees were using a Sears Craftsman drill press that was not anchored to the floor to prevent movement.
