29 CFR 1926.1053(b)(1): Where a portable ladder was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device was not provided to assist employees in mounting and dismounting the ladder. (a) Near Side of the Bridge - Employees used a portable metal ladder to access a 6'4" high bridge deck. The ladder side rails on site extended about 2 feet above the upper level landing and did not have a grasping device to assist employees, observed on or about 5-7-13. Abatement certification required.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system: (a) Freeman's Run Bridge - Employees worked on a 6'4" to 7' high bridge deck taking forms out and tying steel. The two ends of the bridge were open without guardrails and the employees were not wearing fall protection, thereby exposing the employees to a hazard, observed on or about 5-7-13. The Francis J Palo Inc. company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 314108754, citation number 1, item number 2 and was affirmed as a final order on July 7, 2010 with respect to a workplace located at SR 2014, Section 001, Holidaysburg, PA.
