29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of the jobsite, materials, and equipment to be made by a competent person:        (a)Shaw Construction, LLC @ 530 Grand Ave., Grand Junction, CO.  On or before April, 19, 2013 the employer did not ensure that a competent person conducted an inspection(s) of the jobsite to ensure a fall protection system were in place at each unprotected side(s) and edge(s) used by employees as point of access to the first level walking/ working roof surface were no guardrail systems were erected to protect employees from a fall hazard of approximately 11 feet to ground.   As part of injury/accident prevention responsibilities, the employer did not follow its safety program to ensure roofing subcontractors were using fall protection systems while working from the lower and upper roofs of the commercial building under construction. This condition exposed the employees to a fall hazard of approximately 11 feet to ground.     Abatement note: The requirements and duties of a competent person are:     (1)     A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.     (2)     The competent person must understand and be able to carry out the tasks specified in the OSHA standard.  The competent person must have knowledge about fall protection systems or plans, and the safety program.
