On or about May 22, 2013, an employee working on the ground underneath another employee working on the roof was not wearing a hard hat, exposing himself to falling material, debris, and equipment such as but not limited to hammers.

The final order date was January 28, 2013. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. On or about May 22, 2013, 7:12 pitch roof, employees were installing underlayment for cement tiles without the use of fall protection, exposing themselves to an 10 feet 6-inch fall hazard.
