29 CFR 1910.95(g)(1): The employer shall establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels.   a. An employee in the blasting area was exposed to continuous noise at 92.2% of the permissible daily dose level, when measured with a 80 dB threshold, or equivalent sound level of approximately 89.4 dBA for the 420 minute sampling time on July 12, 2013. The employer failed to maintain an audiometric testing program as required for employees exceeding an 8-hour time-weighted average sound level of 85 decibels.  b. An employee in the cutting area was exposed to continuous noise at 70.7% of the permissible daily dose level, when measured with a 80 dB threshold, or equivalent sound level of approximately 87.5 dBA for the 456 minute sampling time on July 12, 2013. The employer failed to maintain an audiometric testing program as required for employees exceeding an 8-hour time-weighted average sound level of 85 decibels.

The employer had not verified, through written certification, that a hazard assessment had been performed.

The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a. On or about May 31, 2013, at the above located workplace, employees were provided with and required to wear a filtering face piece respirator (MSA N95-10102481) for use during granite cutting operations. The employer did not develop or implement a written respirator program that included the provisions with worksite specific procedures for mandatory use.
