29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    a)  Assembly Area - On and prior to June 13, 2013, for employees exposed to head injuries moving around and under the rail machine tools being assembled.  Employees are routinely bending and walking under the machines and no bump caps are worn.      b)  Throughout Manufacturing - On and prior to June 13, 2013, for employees working near the hoists and overhead cranes that are used daily to move parts and equipment.  Employees are exposed to overhead hazards and do not wear hard hats.      c)  Milling and Lathe Areas - On and prior to June 13, 2013, for employees that conduct de-burring on steel products using a hand held tool.  Employees conduct this activity daily and are exposed to laceration hazards from the sharp edges.  Employees do not wear cut resistant gloves.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    a)  Black Oxide Area - On and prior to June 7, 2013, a Surface Preparation Employee used corrosive chemicals to apply blackening surface on steel parts.  The nearby self-contained  eyewash station was dirty, had not been inspected, and the water had not been changed for approximately one year which could allow for bacteria growth.        b)  Black Oxide Area - On June 7 and June 13, 2013, a Crane Operator used corrosive chemicals to apply blackening surface on steel parts.  The nearby plumbed emergency shower was not accessible for use due to 55 gallon drums of chemicals directly under the shower head.

The tanks contained Du-Lite #45 Cleaner (corrosive), Du-Lite SteelKote (corrosive), and Du-Lite KwikSeal (flammable liquid).
