OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On or about July 10, 2013 at 2575 Hamilton-Lebanon Road, Monroe, OH, at a walk-in freezer shed attached to a fast food restaurant, a HVAC & R mechanical contractor employee was exposed to a fall hazard whle climbing up and down on a 6 ft. Werner portable metal step ladder which was leaned up against the wall of a shed to get on top a shed to perform diagnostic and repair work on a ICS freezer unit.

29 CFR 1910.132(a): Application. Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about July 10, 2013, at 2575 Hamilton-Lebanon Road, Monroe, OH, an employee was exposed to an eight foot fall hazard while working on top of shed where an ICS freezer was located without utilizing any fall protection.

Employees shall be trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertain to their respective job assignments. On or about July 10, 2013, at 2575 Hamilton-Lebanon Road, Monroe, an employee who was troubleshooting 208 Volt AC electrical power from a ICS Freezer on top of a shed had not been trained to know the specific personal protective equipment required for this task to pretect himself against electric shock and arc flash.

Note: Personal protective equipment requirements are contained in subpart I of this part. On or about July 10, 2013 at 2575 Hamilton-Lebanon Road, Monroe, an employee was electrical troubleshooting on a 208 Volt AC circuit with a multi-meter and had not worn the appropriate personal protective equipment to protect himself against electric shock and arc flash.
