29 CFR 1910.132(a):  Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.      This violation occurred on july 18, 2013, at a workplace located at 8551 Esters Blvd., Irving, TX 75063; where at least one (1) employee was observed operating a powered industrial truck without the use of a seat belt.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, and were not placed in service if the examination showed any condition adversely affecting the safety of the vehicle. Such examination was not made at least daily. Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift. Defects when found were immediately reported and corrected.    This violation occurred on July 18, 2013, at a workplace located at 8551 Esters Blvd., Irving, TX 75063; where at least three (3) employees were observed driving powered industrial trucks without performing daily inspections on the vehicles.
