29 CFR 1926.600(a)(5): Equipment cab glass introduced visible distortion that affected the safe operation of the machine:    On or about July 18, 2013 the employer did not ensure that a scraper machine's cab glass was free of defects when in operation. The cab glass was dirty, painted on the upper part of the windows and broken/shattered at the front wind shield and side-door window. This condition exposed employees to caught-in-between and struck-by hazards.

29 CFR 1926.602(a)(9)(i): Bidirectional machine(s) were not equipped with an operable horn, distinguishable from the surrounding noise level, which could be operated as needed when the machine is moving in either direction:    On or about July 18, 2013 the employer did not ensure that a scraper machine was equipped with an operable horn when in operation. This condition exposed employees to caught-in-between and struck-by hazards.

29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level.        On or about July 18, 2013 the employer did not ensure that a scraper machine (without sideview mirrors) and a front end loader were equipped with an operable back-up alarm system when in operation. This condition exposed employees to caught-in-between and struck-by hazards.
