29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) 2nd Floor Addition, South Side of the Building - A foreman, project manager and carpenters were observed without fall protection, standing at an unguarded open sided floor while working on the deck exposing them to a 17 foot fall hazard, on or about 07/25/13. b) 2nd Floor Addition, Southwest Corner of the Building -A foreman, project manager and carpenters were observed without fall protection, standing near an unguarded floor hole while working on the deck exposing them to a 10 foot fall hazard through the floor hole, on or about 07/25/13. . c) 2nd Floor, South Side of the Building - A foreman, project manager and carpenters were observed working near an unguarded window opening exposing him to a 17 foot fall hazard, on or about 07/25/13. . Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
