29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a. On or about August 13, 2013 at the above located workplace, employees were required to operate powered industrial vehicles during material handling operations. The employer did not ensure that each powered industrial truck operator completed the required training and evaluated specified in paragraph (l).

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.   a. On or about August 13, 2013, at the above located workplace, employees operated a table saw (Delta 98F97353) to rip vinyl material that did not have the point of operation completely guarded. Employees were thereby exposed to the hazards associated with unguarded points of operation.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  a. On or about August 13, 2013, at the above located workplace, employees performing material cutting and ripping operations were exposed to struck by hazards. These hazards necessitated the use of personal protective equipment such as safety glasses and gloves to prevent occupational injuries or illnesses. The employer had not verified, through written certification, that a hazard assessment had been performed.
