29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: (a) 3rd Floor - Workers were using a 7 ¼ inches Craftsman circular saw and other equipment such as battery chargers that were daisy chained by a three plug multi-adapter being plugged in to a flexible cord that was plugged into a generator, on or about July 30, 2013. (b) 4th Floor - Workers were doing framing work by using a Mikita circular saw that was daisy chained to a flexible cord that was daisy chained to a multi-outlet plate that was daisy chained to another flexible cord, on or about July 30, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 4th Floor - Workers were observed doing framing work near an unguarded window opening that with its ledges 21 ¾ inches to 27 ½ inches above the floor surface without using fall protection and were exposed to a 48 feet fall hazard, on or about July 30, 2013. (b) 3rd Floor - Workers were observed doing framing work near an unguarded window opening that with its ledge 23 inches above the floor surface without using fall protection and were exposed to a 26 feet 2 1/2 inch fall hazard, on or about July 30, 2013. (c) 4th floor - Workers were observed doing framing work near an unguarded floor opening without using fall protection and were exposed to a 10 feet 6 inches fall hazard, on or about July 30, 2013. (d) 3rd Floor - Workers were observed accessing their ladder to the upper floor near an unguarded floor opening with using fall protection and were exposed to a 10 feet 6 inches fall hazard, on or about July 30, 2013. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
