29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists. a) On or about August 29, 2013, an employee tuck-pointing atop the Toledo Blade Building located at 541 North Superior Street in Toledo, Ohio was overexposed to crystalline silica dust. The eight hour time weighted average (TWA) of the overexposed employee was 21.56 million particles per cubic foot (mppcf), which exceeded the permissible exposure limit of 18.94 mppcf, based on the percentage of crystalline silica, 8.2%, in the collected sample.

29 CFR 1910.134(c): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use: (Construction Reference 1926.103) a) On or about August 29, 2013, the employer did not develop and implement elements of the written respiratory protection program to address infeasibility of engineering controls. An employee tuck-pointing atop the Toledo Blade Building located at 541 North Superior Street in Toledo, Ohio was overexposed to crystalline silica dust.
