29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    On or about September 27, 2013, and at times prior to, the employer failed to ensure that employee(s) operating a Crown TR 3000 series tow tractor received adequate training.  Employee(s) were allowed to operate the tow tractor to pull carts without being properly trained in its safe operation.

29 CFR 1910.178(m)(6): A safe distance shall be maintained from the edge of ramps or platforms while on any elevated dock, or platform or freight car. Trucks shall not be used for opening or closing freight doors.    On or about September 27, 2013, the employer failed to ensure that employee(s) operating a Crown TR3000 tow tractor, serial #6A269811 remained a safe distance from the edge of a dock platform.   An employee received fatal injuries when the tow tractor he was on fell from the dock platform.
