29 CFR 1926.1417(b)(1): Failure to ensure compliance with all proceures ncessary for the safe operation of epuipment and attacments.:    The employer does not ensure all cranes used by employees are operated within the cranes rated capacity. This violation occurred on or about September 30, 2013, at a construction site where employees were exposed to struck-by hazards while performing pile driving operations with an auger attachment on a Link-Belt brand LS-248H5 mobile crane without maintaining the crane within its rated capacity.         Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all cranes are operated in accordance with 29 CFR 1926.1417.

This violation occurred on or about September 30, 2013, at a construction site where employees were exposed to struck-by hazards while performing pile driving operations with an auger attachment on a Link-Belt brand LS-248H5 mobile crane without following the manufactures approval instructions and ensuring load charts, procedures, instruction manuals and instruction plates/tags/decals were modified as necessary to accord with the modification/addition.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all modifications/additions made to cranes that can affect their capacity and safe operation meet the requirements of paragraphs (a)(1), (a)(2), (a)(3), (a)(4) or (a)(5) of 29 CFR 1926.1434.
