29 CFR 1910.147(c)(7)(iii)(A):     Retraining was not provided for authorized and affected employees whenever there was a change in the job assignments, a change in machines, equipment or processes that present a new hazard, or when there was a change in the energy control procedures.    The employer did not evaluate whether LO/TO refresher training should be provided to employees when their job assignments had the potential to change due to removal from the workplace of two supervisory employees.

29 CFR 1910.272(e)(2): Employees assigned special tasks, such as bin entry and handling of flammable or toxic substances, shall be provided training to perform these tasks safely.  Note to paragraph (e)(2): Training for an employee who enters grain storage structures includes training about engulfment and mechanical hazards and how to avoid them.  On or about October 10, 2013, the employer had failed to train employees in the task of safe tank entry as encountered at the Big River Rice and Grain Mer Rouge, LA Facility.

29 CFR 1910.272(g)(1)(ii): All mechanical, electrical, hydraulic, and pneumatic equipment which presents a danger to employees inside grain storage structures shall be deenergized and shall be disconnected, locked-out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods.  On or about October 10, 2013, at Tank #1 in the front plant, the employer had failed to ensure that the 113 Incline Auger was deenergized and locked-out before employees entered Tank #1 where the opening to the 113 Incline Auger was located.
