OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about October 24, 2013, employees were exposed to struck-by hazards while performing work around damaged racks. The employer failed to unload, replace or repair damaged racks. The following racks were damaged: a. Support post on the cardboard storage rack in the repack area b. Support post at the end of the rack across from the repack area c. Brace and support post in the center of the rack across from the repack area d. Support posts on the rack in the juice storage area AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THESE HAZARDS IS: 1. Follow the American National Standard Institute (ANSI) MH16.1:2008, Specification for the Design, Testing, and Utilization of Industrial Storage Racks, Section 1.4.1(2), which states, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational housekeeping and maintenance procedures 2. Regularly inspect for damage. If damage is found, immediately unload the affected area and replace or repair any damaged columns, beams, or other structural components.

29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards identified in the hazard assessment: On or about October 24, 2013, employees were exposed to chemical and struck-by hazards when employees were not instructed or monitored to insure that personal protective equipment is used when performing work such as, but not limited to, the following: a. adding water to batteries b. changing batteries c. working in the repack department d. working in the truck shop
