OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an inhalation hazards from hydrogen sulfide (H2S) gas. On or about November 5, 2013, the employer did not provide hydrogen sulfide (H2S) training to the employee working the skimmer operation at the drilling rig in Floresville TX.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about November 5, 2013, at the skimming operation in Floresville TX, an employee did not have a medical evaluation. Employee would be required to wear a Drager SCBA while working in around the skimmer operation that had hydrogen sulfide gas.
