29 CFR 1926.602(d): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178:       29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):      a) The employer did not train and evaluate the employee operating the JLG Gradall 544D-10 all-terrain forklift.       In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms:     a)  Employees engaged in masonry work were not protected from the hazards of falling while working from a tubular welded frame scaffold platform elevated approximately 30 feet above the ground.      Four Province Masonry, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(4)(i), which was contained in OSHA inspection number 312599475, citation number 1, item number 1 and was affirmed as a final order on December 17, 2009, with respect to a workplace located at 112 W. Hubbard St., Chicago, IL 60654.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
