29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) At Jobsite: Outback Steak House, outside building - Employees performing brick laying operations from a fabricated frame scaffold were exposed to fall hazards of approximately fifthteen (15) feet without the use of personal fall arrest systems or guardrail systems. Noted on or about 09/05/13.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access:    a) Jobsite: Outback Steak House, outside the building - The portable extension ladder used to access an upper landing surface did not extend at least three (3) feet above the upper working surface exposing employees to a fall hazard of approximately 15 feet during access and/or egress.  Employees used the ladder to gain access to the working platforms of a fabricated frame scaffold. Noted on or about 09/05/13.
