29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:  a)  In the Repair Shop - On or about March 10, 2014, an employee was observed to have a voluntary-use NIOSH-approved 3M air purifying elastomeric facepiece respirator with organic vapor cartridges and N95 dust prefilters, and the employer had not established nor implemented a written respiratory protection program, including, but not limited to a  medical fitness evaluation; annual respiratory protection fit testing; and training in the proper use and limitations, care for, cleaning, disinfecting, and storage of, respiratory hazards requiring respirator use, and possible health hazards involved in using respiratory protective equipment for employees filling and chipping hardened concrete residue out of the barrels of concrete trucks.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(k)(3): Training was not provided prior to requiring employees to use a respirator in the workplace:  a)  In the Repair Shop - On or about March 10, 2014, the employer had not provided employees, using NIOSH-approved 3M elastomeric half-face air purifying respirators with organic vapor cartridges and N95 dust prefilters with effective, comprehensive, and understandable information and training on the respirators provided for the employees use in the workshop prior to their use of these respirators.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a)  In the Repair Shop - On or about March 10, 2014, an employee, maintaining concrete trucks, was voluntarily using a NIOSH-approved 3M 8511 two-strap dust mask respirator without being trained on the contents of 29 CFR Part 1910.134 Appendix D.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv): Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information:  a)  Throughout the facility - On or about March 10, 2014, the employer had not conducted training on the revised HCS 2012 shipping container labels, the hazard pictograms, and safety data sheet organization for the workplace hazardous chemicals, such as but not limited to Portland Cement, respirable Crystalline Silica, respirable dust (PNOR, Particulates Not Otherwise Regulated), Oxygen, Acetylene, and Diesel Fuel so that the employees could find and apply the hazard information.    Abatement certification required within 10 days after abatement date.
