29 CFR 1910.303(f)(1): Each disconnecting means required by Subpart S of Part 1910 for motors and appliances was not legibly marked to indicate its purpose, nor located and arranged so the purpose was evident:  a) for the electrical breakers on the east wall in the manager's office located at 3206 Tamiami Trail in Port Charlotte (FL), as noted on or about 03/15/14.  The electrical breakers for appliances and equipment such as but not limited to fryers, coolers, ventilation, lights, outlets, etc . . were not legibly marked as to their functionality.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):   a) for the electrical breaker boxes on the east wall in the manager's office located at 3206 Tamiami Trail in Port Charlotte (FL), as noted on or about 03/15/14. The two breaker boxes were not protected from accidental contact as they had no approved enclosure.

29 CFR 1910.333(a)(1): Live parts to which an employee was exposed were not de-energized before the employee worked on or near them:  a) For the Taylor Frosty Dairy Dessert Machine (Model # 358-33 - Serial # K2082570) located in the restaurant front counter area at 3206 Tamiami Trail in Port Charlotte (FL), as noted on or about, 03/15/14. The Frosty machine was not de-energized prior to removing the machine's cover panels in order to service the pulley drive belt.

29 CFR 1910.332(b)(3)(i): Employees were not trained in and familiar with the skills and techniques necessary to distinguish exposed live parts from other parts of electric equipment:  a) Employees working as qualified, appliance maintenance technicians for the Wendy's restaurants of B.F. Fort Myers, as noted on or about 03/15/2014 weren't adequately trained on the skills and techniques to distinguish live exposed parts from other parts of electric equipment.
