29 CFR 1926.300(b)(1): Employer did not ensure power operated tools designed to accommodate guards, were equipped with such guards when in use. a). 6 Platt Street, New York, NY 10003, 21st Floor South Side. Employees were installing new tiles in the Bathrooms on the 21st floor. Employee was using a Makita Brand 4" electric Grinder with an exposed tile cutting wheel to trim tiles to size for placement. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.404(f)(6): Grounding path. Employer did not ensure the path to ground from circuits, equipment, and enclosures were permanent and continuous. A). 6 Platt Street, New York, NY 10003, 21st floor south side. Employee was utilizing a Makita Brand 4" grinder energized by a flexible extension chord plugged into temporary building electric. The extension chord utilized by the employee was not protetced from ground faults because the grounding pin had been broken off/removed. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
