29 CFR 1926.1101(f)(2)(i): The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace: (a) Shaw Construction, 625 E. Hopkins Ave., Aspen, CO 80611: On or before March 10, 2014 the employer did not ensure an exposure assessment, in the absence of a negative exposure assessment, was conducted for the worksite prior to the beginning of demolition activities. Temporary employees working for several days in the green barn, under the direction of the employer removed drywall texturing which contained 2% Chrysotile asbestos. This condition exposed employees performing Class II asbestos removal activities to respiratory hazards such as asbestosis. Abatement Note: Abatement certification is not required for this item.

29 CFR 1926.1101(g)(1): The employer did not use engineering controls and work practices in all operations covered by 29 CFR 1926.1101, regardless of the levels of the exposure: (a) Shaw Construction, 625 E. Hopkins Ave., Aspen, CO 80611: On or before March 10, 2014 the employer did not ensure engineering or work practice controls were implemented by temporary employees who were conducted Class II asbestos removal activities regardless of exposure. Employees removed drywall texturing which contained 2% Chrysotile asbestos over a period of several days without the use of control methods. This condition exposed employees to respiratory hazards such as asbestosis. Abatement Note: Abatement certification is not required for this item.

Hopkins Ave., Aspen, CO 80611: On or before March 10, 2014 the employer did not ensure a competent person, as defined by this standard, was overseeing the demolition operations which included Class II asbestos removal of drywall texturing that contained 2% Chrysotile asbestos. This condition exposed employees to respiratory hazards such as asbestosis. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
