29 CFR 1910.23(a)(3)(ii): Where operating conditions necessitate the feeding of material into any hatchway or chute opening, protection shall be provided to prevent a person from falling through the opening:   At the SPVC Unit, ST-501A tank, employees working at the top hatchway of the tank was not protected against falls into the tank.  An appropriate or suitable means of fall protection was not provided.

29 CFR 1910.146(c)(2): The employer did not inform exposed employees, by posting danger signs or by any other equally effective means, of the existence and location of and the danger posed by the permit spaces:   At the SPVC Unit, ST-501A tank, employees engaged in washing the interior of the tank were exposed to a permit-required confined space.  The employer did not have the top manway posted with language identifying this tank as a danger and being a permit-required confined space.

29 CFR 1910.146(c)(8): The employer (host employer) arranged to have employees of another employer (contractor) perform work that involves permit space entry, the host employer did not inform the contractor of the criteria as specified in 29 CFR 1910.146(c)(8)(i) through (iii):   At the SPVC Unit, ST-501A tank, the host employer did not advise the contractor of the following issues and conditions contract employees could encounter while rinsing the tank:   a.  that the workplace contained permit spaces and that permit space entry is allowed only through compliance with a permit space program meeting the requirements of this section;   b. the elements, including the hazards identified and the host employer's experience with the space, that make the space in question a permit space; and,   c.  any precautions or procedures that the host employer has implemented for the protection of employees in or near permit spaces where contractor personnel will be working.
