29 CFR 1926.1434(a): Modifications or additions which affect the capacity or safe operation of the equipment were made and did not meet the requirements of paragraphs (a)(1), (a)(2), (a)(3), (a)(4) or (a)(5) of this section. a. On or about 05/07/2014, at the job site - the National truck crane had been modified to allow the attachment of a JLG man basket (square openings were drilled/cut on both sides of the hollow bull nose so an attachment fabricated out of hollow steel tubing could be inserted into the bull nose). Those modifications were made under the direction of the owner without prior approval from the manufacturer or a registered professional engineer.

On or about 05/07/2014, at the job site - Under the direction of the employer, and not a qualified person familiar with structural design, the JLG man basket had been modified by adding angle iron and a lever to keep the man basket level and an attachment had been fabricated out of hollow steel tubing to attach the man basket to the bull nose of the crane.
