29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall or come against, was not guarded to eliminate the hazard of impalement.    On or about June 3, 2014 at the worksite located at 39552 W140th St. Cleveland, OH on a supported scaffolding on the east side of the site, the employer allowed employees to work above unprotected reinforcing steel rebar with only a toprail protecting them from falling approximately 13.3 ft.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.    On or about June 3, 2014 at the worksite located at 39552 W140th St. Cleveland, OH on supported scaffolding on the west side of the site, the employer allowed employees to work unprotected from falling from a height approximately 13.5 ft. high by guardrails or another means of fall protection.    Foti Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1), which was contained in OSHA inspection 314416611, citation number 1, item number 1 and was affirmed as a final order on 6/21/2010, with respect to a workplace located at 2482 State Rt. 534  Southington, OH 44470.
