Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls.  (a) Front side, new apartment construction located at Building #2500 Ashley Park Blvd., Newnan, GA 30263: Employee was exposed to falls while working at heights of approximately 12-feet from the lower level from a job-made basket/platform which was resting on the forks of a JLG (Model - 644E-42) Lull All-Terrain Forklift Truck with no fall protection system in place.  The basket/platform was:     1) not approved.     2) missing mid and top guardrails or attachment for personal fall arrest system.     3) not secured to the forks of the Lull.
