OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to the hazard of being struck by vehicular traffic: a) Bayberry Drive - Employees were exposed to a vehicular struck-by hazard while performing asphalt paving activities, in that, the channeling devices (cones) used to taper a lane of traffic approaching a work area were not spaced far enough apart as was prescribed in the applicable engineering study/recommendations.
