The workers were exposed to falls of over 9 feet to sidewalk, dirt and stones below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: The employer is failing to protect employees from fall hazards by not ensuring that ladders being used on site extend 3 feet above the upper working surface. The employees are exposed to a fall from heights of greater than 9 feet to concrete below.
