29 CFR 1910.178(l)(2)(ii): Training did not consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  On or about 7/14/2014, an accident occurred when the JCB Loadall (507-42, 443617, 7000 lb) tipped over during a multi-lift involving a hydro mobile scaffold and attached bridges.  Upon investigation the employer failed to ensure that operator training for rough terrain vehicle operation included a driver's performance evaluation as specified in 29 CFR 1910.178 (l).

29 CFR 1926.251(a)(1): Defective rigging equipment was not removed from service:  On or about 7/14/2014, an accident occurred when the JCB Loadall (507-42, 443617, 7000 lb) tipped over during a multi-lift involving a hydro mobile scaffold and attached bridges.  The wire rope used with the JCB Loadall had an illegible weight capacity tag.  Upon investigation this wire rope was still not tagged out of service on 7/24/2014.

Upon investigation, the employer failed to ensure that a competent person safely directed the movement of a M2 hydro-mobile scaffold and attached bridges.

29 CFR 1926.602(c)(1)(iii): If a load is lifted by two or more trucks working in unison, the proportion of the total load carried by any one truck shall not exceed its capacity.  On or about 7/14/2014, an accident occurred when the JCB Loadall (507-42, 443617, 7000 lb) tipped over during a multi-lift involving a hydro mobile scaffold and attached bridges.  Upon investigation, it was determined that the load capacity for the JCB Loadall exceeded its capability when the operator backed up and extended the boom in order to position the load in a tightly restricted area.
