29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about August 8, 2014, and at times prior thereto, the employer failed to provide training in recognizing the hazards of striking metal hammer heads against tools of the same type of metal, exposing employees to the hazards of being struck by flying metal fragments.

29 CFR 1926.301(a): Unsafe hand tool(s) were issued or permitted to be used: On or about August 8, 2014, and at times prior thereto, a railroad spike maul was used improperly as a backing out hammer for the removal of tower crane anchor pins. The striking face on both ends of the tool had excessive pitting, wear, and damage, exposing employees to the hazards of being struck by flying metal fragments.

29 CFR 1926.301(d): Wooden handles of tool(s) were not free of splinters or cracks and were not kept tight in the tool: On or about August 8, 2014, and at times prior thereto, a railroad spike maul used as a backing out hammer to drive pins from a tower crane anchor and concrete floor had a cracked wooden handle and was loose at the head of the tool, exposing employees to the hazards of being struck by flying objects.
