29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: Located at the Anoxic Tank project, a 17 foot deep excavation inType B soil sloped at an angle of about 75 degrees to the horizontal (about 0.27 horizontal to 1 vertical) for about 48 feet from north fact of the trench was not inspected by a competent person exposing employees to the hazards of cave-ins.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: Located at the Anoxic Tank project, the employer failed to provide to employees a protective system while working in a trench that was 17 foot deep excavation in Type B soil sloped at an angle of about 75 degrees to the horizontal (about 0.27 horizontal to 1 vertical) for about 48 feet from north face exposing the hazards of cave-ins.
