29 CFR 1915.507(b)(1): The portable fire extinguishers and hose systems were not selected, installed, inspected, maintained, and tested by the employer according to NFPA 10-2002 Standard for Portable Fire Extinguishers. a) On or about 09/15/2014, at the maintenance shop at Cherokee Marine Terminal located at 520 Cowan Street, in Nashville, TN, the employer exposed employees to fire hazards by not having portable fire extinguishers accessible and the monthly fire extinguisher checks not being conducted and documented to ensure the proper function of the extinguisher. Fire extinguishers were located on either side of the main shop door and their access was blocked by equipment in the shop. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

(a) On or about 09/15/2014, an employee was exposed to dust while working at the Cherokee Marine Terminal facility located at 520 Cowan Street, in Nashville, TN, and was provided a 3M 8210 N95 respirator to wear when sweeping out barges and was not given information contained in Appendix D of 29 CFR 1910.134. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(1)(i): The employer did not compile a complete list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet. a) On or about 09/15/2014, Cherokee Marine Terminal located at 520 Cowan Street, in Nashville, TN, did not develop a complete inventory list of hazardous materials currently being used by employees to complete work tasks in the maintenance shop and dock areas. The chemical inventory list did not include (at minimum) oxygen and acetylene compressed gases, Buckeye and Sentry fire extinguishers, 2 cycle oil, cement, welding rods, diesel fuel, and gasoline (all eye, skin, and/or respiratory irritants). In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

(a) On or about 09/15/2014, employees working at the Cherokee Marine Terminal facility located at 520 Cowan Street, in Nashville, TN, were exposed to an unlabeled hazardous material (reported to be cement) in a 55 gallon white barrel in the maintenance shop. Exposure to unknown hazardous materials could expose employees to potential acute and chronic illness. 29 CFR 1910.1200(g)(1): Employer did not have a safety data sheet in the workplace for each hazardous chemical which they use. a) On or about 09/15/2014, employees working at the Cherokee Marine Terminal located at 520 Cowan Street, in Nashville, TN, were exposed to various hazardous materials (including but not limited to compressed oxygen and acetylene gases (used for welding operations); Buckeye and Sentry fire extinguishers; various oils; transmission fluid; battery terminal protector(spray); cutting fluid; carb and choke cleaner; spray paints; break parts cleaner; antifreeze; cement; welding rods; diesel fuel; and gasoline and did not have a safety data sheet (SDS) for each hazardous material (all are eye, skin, and/or respiratory irritants). Without proper information on hazardous materials, employees could mis-handle materials and expose themselves to allergic reactions, and various irritations both internal and external. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
