OSH Act of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely cause death or serious physical harm to employees in that employees were exposed to combustible fiberglass reinforced plastic (frp) dust deflagration, explosion, and other fire hazards while working at or near a cartridge filter dust collection system that was not designed and located to prevent or minimize employee exposure in the event of an internal deflagration or other fire event: On or about October 6, 2014 the indoor Torit DF2 2DF4 (SN # IG333420-001) cartridge filter dust collector servicing the CNC operation by collecting combustible fiberglass reinforced plastic (frp) dust presented the following recognized hazards: (a) The Torit dust collector was located indoors and lacked a means of explosion protection. (b) The Torit dust collector was located indoors and lacked a means of deflagration propagation protection (isolation) for the upstream cyclone and CNC operation as well as the units dust discharge (hopper) area. (c) The Torit dust collector was located indoors and lacked means to prevent the transmission of the effects of a fire (heat, smoke, embers) or a deflagration (pressure front, propagating flame front) to indoor locations through the return air (filtered air) discharge.
