29 CFR 1926.200(a): Required signs and symbols were not visible when work was being performed: (b) Chester Bross Construction Co. on or about September 29, 2014 had workers performing flagging operations and doing grinding where traffic was turning into the work area from Highway 13 at the entrance to WalMart. Signs were not present to warn of the construction work and the presence of flaggers ahead. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition): (b) Chester Bross Construction Company on or about September 29, 2014 had flaggers posted and flagging traffic at an exit from Hwy 13 in Ray County, and the flaggers were not wearing Class 2 Level 2 high visibility reflective clothing as required by the Manual on Uniform Traffic Control Devices. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
