OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a Struck-by hazard: Near entrance to job site: On or about October 17, 2014, employees were exposed to the hazards of being struck by falling objects while working near the bucket of a Komatsu Hydraulic Excavator, Model PC300, that had the manufacturer's main boom pin and the H-pin replaced with rebar which could result in the bucket or load becoming free and striking the employees.
