OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible dust fire hazards while working at or near indoor cartridge filter dust collectors which returned filtered air directly back into the facility:    Outside of Blending Room 1, 2 and 3: Three indoor Donaldson Torit Downflo cartridge filter dust collectors used to collect combustible powdered drink/food mix dusts generated in Room 1, 2 and 3 exhausted back into the facility and lacked a means of fire protection.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903. 19(c).

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    Nestle Tea Line 6: The employer did not ensure that the Nestle Tea Labeler on line 6 was adequately guarded in that, an employee was able to open the guard while the machine was still running to line containers and/or repair labels, exposing the employee to a fracture or caught in hazard.    Documentation required for this item in accordance with the requirements of 29 CFR 1910. 1903.19(d).

29 CFR 1910.303(g)(1)(ii): The required working space about electric equipment rated 600 volts, nominal, or less to ground, was used for storage:    Lines 4, 5, 6: The working space around the circuit breaker panels was obstructed with cardboard boxes, exposing employees to the hazards associated with not being able to turn off the power in an emergency, and the employer did not ensure the required working space around electrical equipment was maintained.    Certification required for this item in accordance with the requirements of 29 CFR 1910. 1903.19(c).
