OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees working inside a confined space:       This violation occurred on or about December 1, 2014 at a jobsite located at 1601 Elm Street, Dallas, Texas; at the water storage tank #2 where the employer did not provide a place of employment which was free from recognized hazards:    a) Best Mechanical, Inc. employees working and performing hot work operations, to include oxy/acetylene cutting, were exposed to a flammable atmosphere.      Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working inside water storage tank #2 are provided with specific safe entry procedures.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user:      This violation occurred on or about December 1, 2014 at a site located at 1601 Elm Street, Dallas, Texas; at water storage tank number two (2) where the employer did not establish elements of a written respiratory protection program for Best Mechanical, Inc. employees wearing half-facepiece, tight-fitting respirators.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:      The employer did not ensure a written hazard communication program was developed, implemented and maintained at the jobsite. This violation occurred on or about December 1, 2014, at a jobsite located at 1601 Elm Street, Dallas, Texas; at the water storage tank number 2 where the employer did not implement a written hazard communication program for Best Mechanical employees handling oxygen and acetylene gases when operating an oxygen/acetylene cutting torch.
