OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard by a Caterpillar 966G Front End Loader Series II:    a.  On or about December 16, 2014, at the north side of the transfer station area, the employer did not ensure that the Caterpillar 966G Front End Loader Series II was in safe operating condition in that the loader:      1. did not have a working backup alarm,    2. the windshield was cracked in the line of sight of the operator, diminishing visibility,    3. there were no rear view mirrors,    4. the lights and horn were not working,    exposing employees to the hazard of being run over by the equipment.  Among other methods, a feasible abatement method to correct this hazard was to comply with the precepts of the Association of Equipment Manufacturer's Safety Manual for Wheel Loader/Tractor Equipment.  In the "Check the Safety Equipment" section of this manual, it indicates to check for equipment safety, such as backup alarms, windows, mirrors, lights and horn to ensure that these items are securely in place and in operating condition.
