Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:     (a) On December 15, 2014, for the employee directing truck traffic on a well site who was fatally injured after being pinned between a semi-trailer and a water tank at the Schneider Well Site #3-28-3314 near Manning, North Dakota.     Abatement Note:  Among other methods, feasible and acceptable abatement methods to correct the hazard would be for the employer to develop and implement a Site Traffic Control Plan to address hazards of being struck by equipment.        Effective methods include, but are not limited to, installing protective concrete barriers between frack tanks and truck traffic. Protective concrete barriers would allow for a buffer zone where employees could work directing traffic or use as a safe standing area.        Also, to ensure proper lighting is staged where interaction between truck pusher and truck drivers occurs. Thorough lighting would reduce blind spots during dawn, dusk and evening operations.
