OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured:     a)Maintenance shop area area; On or about January 16, 2015 and at times prior, the employer exposed his employees to the hazard of being struck by fragments of Polyvinyl Chloride (PVC) plastic pipe in the event that the PVC plastic pipe ruptured. PVC plastic piping was used in exposed above ground locations to transport compressed air at 120 psi. The employer failed to follow ASME Gas Transmission and Distribution Piping Systems - ASME Code for Pressure Piping, B31. Section 842.3.3 Installation Provisions which prohibits the above ground use of PVC pipe for compressed air conveyance.

The accident that caused hospitalization occurred at approximately 1:00 PM on January 12, 2015. The employer informed the area office at approximately at 1:55 PM on January 14, 2015.
