29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) On February 3, 2015 the inspection revealed that the vertical belt sander in the welding shop was not guarded at the pinch points between the belt and pulley, potentially exposing employees to serious injury. (b) On February 3, 2015 the inspection revealed that the blade on the vertical bandsaw in the welding shop was not guarded underneath the work rest, potentially exposing employees to serious injury. (c) On February 3, 2015 the inspection revealed that the blade on the horizontal bandsaw in the welding shop was not guarded between the left side of the frame and the left side guider roller, potentially exposing employees to serious injury.

This exposed employees to laceration hazard to the hands from incidental contact with the blades.

29 CFR 1910.134(e)(1) is applicable to shipyard employment by 1915.154 that incorporates the General Industry requirement: The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On February 3, 2015 the inspection revealed that the employer did not complete the medical evaluation process by sending questionnaires to a physician or other licensed health care provider for evaluation. Astoria Marine Construction Co was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 312392509, citation number 1, item number 1b and was affirmed as a final order on 8/18/2010, with respect to a workplace located at 92134 Front Road in Astoria, Oregon.
